First Alert™ BACK TO SCHOOL Safes Tweet-Away Twitter Contest
Official Sweepstakes Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
1. ELIGIBILITY:
The “Back to School Safes Tweet-Away Twitter” Contest (the "Contest") is offered only to legal residents of the United States who are at least 18 years old at time of participation. Employees, officers and directors of First Alert, Inc. and Jarden Corporation (collectively “First Alert” or “Sponsor”), L.C. Williams & Associates (“Sweepstakes Administrator”), their respective parents, affiliated and subsidiary companies, advertising and promotional agencies, and each of their immediate family members (parents, siblings, children and spouse, wherever they reside) or household members (whether or not related) are not eligible. Groups, clubs, organizations, commercial entities, and businesses are not eligible to participate. The Contest is void where prohibited by law and is subject to all applicable federal, state and local laws and regulations. Separate official rules for the Contest are available on the Website (as hereinafter defined).
2. SWEEPSTAKES PERIOD:
Entries for the Contest may be made during the period commencing on Monday, August 30, 2010 at 12:01 a.m. Central Time (CST) and ending on Friday, September 3, 2010 at 11:59:59 p.m. (CST).
3. METHOD OF ENTRY:
No purchase necessary. To enter, Twitter users must Tweet to First Alert (using @FirstAlert), an answer to “What do you put in your safe?” with the hashtag, #B2SchoolSafes, and “follow” @FirstAlert on Twitter. All entries will be considered. Five (5) winners will be chosen on Tuesday, September 7, 2010 at random to win.
4. HOW TO PLAY:

- Wednesday, September 1: What would you put in your safe? Enter the #B2SchoolSafes TweetAway by Aug. 20.
- Thursday, September 2: Five First Alert safes up for grabs! Great for dorm rooms, apts. Enter the #B2SchoolSafes TweetAway to win!
- Friday, September 3: Today is the last day to enter the # B2SchoolSafes TweetAway. Reply, follow and Tweet till 11:59 p.m. CT tonight!
- Will Tweet to announce winner on Tuesday, September 7

5. NOTIFICATION OF WINNER: If you are notified that you are an instant winner, you will be provided with an Affidavit of Eligibility and Liability Release (where lawful) by mail. In order to claim your prize you must complete and sign and return the Affidavit within 14 days after notification. If Sponsor determines that all Contest rules have been complied with, your prize will be mailed to the address provided during the registration process. If Affidavit is not returned on a timely basis, or if any prize is returned as non-deliverable, or if any participant is found to be ineligible or not in full compliance with these Official Rules, such prize will be forfeited and will be awarded to an alternate participant selected in a random drawing from among all eligible entries. The decisions of Sponsor and Sweepstakes Administrator are final. Acceptance of any prize constitutes permission for Sponsor and its designees to use winner’s name and/or likeness for purposes of advertising and trade in any medium, without further compensation, unless prohibited by law. An IRS Form 1099 will be filed, if required, for each prize awarded.
6. PRIZES:
Five (5) First Alert™ Water Fire Protector File Chest 2037F Safes.
Approximate retail value of the prize: $64.99.
The odds of winning a prize are based on the number of eligible entries. Prize winners are solely responsible for all costs and expenses not specified in these Official Rules. Prizes may not be transferred, assigned, redeemed for cash or substituted, except that Sponsor may substitute any prize component with a prize component of equal or greater value should stated prize become unavailable for any reason.
7. GENERAL RULES:
Entries submitted in any manner other than as stated in these Official Rules are void and will not be honored. The sale, trading, auction, transfer, assignment, combining, or barter of entries is prohibited. This Contest is not to be combined with any other offer. Except as expressly stated above, Sponsor shall have no liability or obligation with respect to any void entry. All entries are subject to verification by Sponsor. Anti-fraud detection devices may be used for verification purposes. Sponsor and/or Sweepstakes Administrator, have the right, at their sole discretion, to disqualify any individual found, to be tampering with the operation of the Contest or any Website, or to be acting in violation of these Official Rules. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Contest will void any attempted participation effected by such methods and result in disqualification of participant utilizing same. If, for any reason, the Contest (in whole or in part) in the sole opinion of Sponsor is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and/or proceed with the Contest (including the award of the prizes) in a manner deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on the Website. Sponsor and Sweepstakes Administrator are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Contest prizes.
8. LIABILITY:
Participants agree that Sponsor, Sweepstakes Administrator, reward and prize suppliers, and their respective parents, subsidiaries and affiliated companies, advertising and sweepstakes agencies, and all of their respective officers, directors, employees, representatives and agents (individually and collectively “Releasees”) will have no liability whatsoever for, and shall be indemnified and held harmless by participants against, any liability for any injuries, losses or damages (whether due to negligence or otherwise), of any kind to person(s), or property, resulting in whole or in part, directly or indirectly, from participation in this Contest. In no event will Releasees be responsible or liable for any damages or losses of any kind, whether direct, indirect, incidental, consequential, punitive or otherwise. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF ABOVE LIMITATIONS MAY NOT APPLY. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS.
Releasees are not responsible for illegible, lost, late, incomplete, stolen, misdirected, undeliverable submissions; or for any computer, programming, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/Website/use net accessibility, availability, or traffic congestion, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of registration information, entries, or the failure to capture, or loss of, any such information.
9. DISPUTE RESOLUTION/CHOICE OF LAW/JURISDICTION:
Except where prohibited, participants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by an action in state or federal court located in the appropriate courts in the state of Illinois and expressly agree and consent to the subject matter and personal jurisdiction of such courts; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys' fees; and (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participant and/or Sponsor and/or Sweepstakes Administrator in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the state of Illinois without regard to conflicts of law principles.
10. SWEEPSTAKES ADMINISTRATION: The Sweepstakes Administrator is responsible for the administration and execution of the Contest. Sponsor is not responsible for the collection, submission or processing of entries, conduct or the overall administration of the Contest. Entrants should contact the Sweepstakes Administrator, L.C. 11. WINNERS LIST: For the names of Contest prize winners, mail a stamped self-addressed envelope to: First Alert, Inc. c/o L.C. Williams & Associates; 150 N. Michigan Ave., Suite 3800, Chicago, IL 60601. Request must be received by October 18, 2010. Allow 6 weeks for fulfillment of request.
